Supplemental Register

Definition:
A register of words, symbols, package trade dress, product or container shapes, or slogans that do not qualify for registrable trademark status but can achieve trademark status once they acquire secondary meaning.

Classification of Goods & Services

Definition:
Are classified by an international system, according to international treaties to which the United States is a signatory. All goods and services included in trademark applications are classified by the Office according to this system.

Goods and Services

Definition:
The activity performed must be qualitatively different from anything necessarily done in connection with the sale of the applicant’s goods or the performance of another service.

Supplemental Register

Definition:
Secondary trademark register for the USPTO. It allows for registration of certain marks that are not eligible for registration on the Principal Register, but are capable of distinguishing an applicant’s goods or services.

Appellation Of Origin

Definition:
A term that refers to both a product's geographic origin and to its distinctive product characteristics caused by particular geographic conditions or methods of production.

Patent

Definition:
A grant by the federal government to an inventor of the right to exclude others from making, using, or selling his or her invention.

Examiner's Amendment

Definition:
Is merely a written confirmation of the agreement between the examining attorney and the applicant as to the amendment, and it is also a notice that the amendment will be made.

Pseudo Mark

Definition:
A way of locating a word mark that is comprised of an alternative or intentionally corrupted spelling of an English word.
